SATRESKRIM POLICE PERFORMANCE IN HANDLING LAND CRIMES

Abstract

The main duties of the Indonesian National Police are to maintain public order and security, to provide protection, protection and services and to enforce the law as stipulated in Chapter III Article 13 of Law Number 2 of 2002 concerning the main duties of the Police. Law is all the rules that apply in life together, which contains all the rules that can be imposed with a sanction. The method used in writing this applied paper is descriptive analytical method, namely by using data that clearly describes the problems directly in the field, then analyzed and then drawn conclusions to reach a resolution of the problem. The results of this study indicate that law enforcement can take place formally and peacefully, but it can also occur because violations of the law must be upheld. Law enforcement by the police also includes criminal acts that occur in cases of land disputes in the jurisdiction of the police throughout Indonesia.

INTRODUCTION

The National Police of the Republic of Indonesia or often abbreviated as Polri concerning the Government is one of the functions of the state government in the field of maintaining security and public order, law enforcement, protection, shelter, and service to the community, which aims to realize domestic security which includes the maintenance of security and public order, orderly and upholding the law, the implementation of protection, protection, and service to the community, as well as the establishment of community peace by upholding human rights (Iskandar, 2019). There has been a shift in the paradigm of government administration from the paradigm of rule government to good governance, this condition was followed up by the leadership of the National Police with the National Police Bureaucratic Reform program (Putra, 2019). Police reform is also the basis for all changes in the performance of the National Police in the field, which is adjusted to the expectations of the community, which requires the Police to provide a sense of security and excellent service to the community.


About the life of the state, the National Police is a state instrument that plays a role in maintaining public security and order, enforcing the law, and providing protection, protection, and services to the community in the context of maintaining domestic security (Turnip, 2018). Amid an increasingly difficult situation like this, the Police are faced with many challenges, besides being able to be good law enforcement officers, the Police must also be good at being partners with the community in terms of service, especially the people who are seeking justice, this is by Pancasila and 1945 Constitution. The people's expectations for the Police are only two things: First, they need the maximum security and protection of the Police for themselves, their families, and their property; second, they want better service from the Police (Konny, 2011). As one of the public sector organizations, the professionalism of the police organization's performance is strongly influenced by human resources and individual behavior

for we need appropriate HR management to optimize according to community expectations.

The investigation process is the most crucial stage in the Criminal Justice System, where the investigative tasks assigned to the National Police are very complex, apart from being investigators as well as supervisors and coordinators for PPNS investigators (Pasue, 2017). As reforms are passed in every sector of Indonesia, the complexity of Agent Polly's mission increases. Investigators are required to successfully uncover all cases that are indicated to have violated the law they are handling. In addition, investigators are also required not to violate Human Rights (HAM) in investigating someone suspected of committing a crime (Suswantoro et al., 2018). Another challenge for Investigator Polri arises not only from the prosecutor's office's successful referral of the case to court and from the potential prosecution of suspects and their families through Investigator Polri's negligence of the pre-trial process tracked.

Land dispute cases are a juridical area of the agrarian sector and therefore become part of civil procedural law. However, it is undeniable that in the process of violating civil law, in connection with these legal matters, crimes committed by individuals are often seen (Nurwahid, 2016). Various criminal acts that occur in cases of land disputes are also often found in the jurisdiction of the Police throughout Indonesia. The main task of the State Police of the Republic of Indonesia is to maintain public security and order, to provide protection, protection, and services as well as to enforce the law as regulated in Chapter III Article 13 of Law Number 2 of 2002 concerning the main tasks of the Indonesian National Police. The law is the entire code of conduct that applies in usual life, containing alluring rules that can be imposed with a sanction. The implementation of the law can take place formally and peacefully, but it can also occur because violations of the law must be enforced (Mintawati & Budiman, 2022).

 

METHOD RESEARCH

The method used in writing this applied paper is the descriptive analytical method, namely by using data that clearly describes the problems directly in the field, then analyzing and then concluding to reach a problem-solving (anur Tarihoran, 2021). The method of collecting data is through observation and literature study to obtain problem-solving in the preparation of this paper (Sulistiyani, 2019).

Sociological juridical approach, namely the juridical approach method used to examine problems in terms of law and systematics and as a guide to the rules that can be used as the basis for analyzing legal phenomena that arise. A sociological approach is an approach used to examine a problem in society or the community environment with the intent and purpose of obtaining facts, followed by finding problems, identifying problems, and finding solutions to problems.

 

RESULT AND DISCUSSION

A.     Human Resources in Harda Satreskrim Polres X Currently

Overall, the current Harda Polres X personnel strength is 1,309 personnel, namely:

The data above shows that the number of members of Polres X at this time has not been able to balance the population of the jurisdiction of Polres X as many as 2,106,763 people, with a ratio of 1: 1691 people, with a population density of 1,1498 people/ha. This means that the Police ratio still does not meet the UN standard ratio of 1: 400 (Uliyah et al., 2017).

From the table, it can be seen that there are still shortages in PA that are not in accordance with DSP and BA dislocations as many as 179 people exceed the DSP which should be 379 people, while civil servants experience dislocation as many as 19 people.

 

B.      Land Case Handling Mechanism at Harda Polres X

The mechanisms for handling land cases at Harda Polres X are as follows;

1.    Human Resources in the Harda Polres X unit are not good enough in quantity or quality.

2.    Always coordinate with the prosecutor's office so that every land case can be resolved properly.

3.    Cooperation between the Harda Polres X unit and other related parties.

4.    Coordinate or study case studies with top-level units to find all problems that arise related to land crimes that have permanent legal decisions which will later be used as references in resolving land criminal cases.

To increase the professionalism of investigators/assistant investigators in handling cases of land crimes.

 

C.     Human Resources

When viewed in terms of quantity or number of investigator personnel of the Harda Polres X unit, it is still lacking (Kuncoro, 2011). For this reason, it is necessary to add additional investigators/assistant investigators because there are so many reports from the public about criminal acts, especially land cases that are submitted to Polres X so there are obstacles for investigators/assistant investigators in disclosing cases. In terms of quality, the investigators/assistant investigators of the Harda Polres X unit are expected to be:

a.    Investigator/assistant investigator of the Harda Polres X unit who has a bachelor's background in the field of law.

b.    Investigators/assistant investigators of the Harda Polres X unit who have insight and experience in dealing with problems, especially regarding land criminal cases.

c Investigators/assistant investigators of the Harda Polres X unit are expected to attend seminars, pieces of training, or vocational training on land crimes.


 

D.     Facilities and Infrastructure

As explained above, the supporting facilities and infrastructure owned by the Harda Polres X unit are limited. Meanwhile, to carry out inspections of the Harda Polres X unit, they still use laptops or computers, and printers belonging to the personal property of each personnel. Therefore, to improve the professionalism of the performance of investigators/assistant investigators, it is expected that:

a.    Procurement of facilities and infrastructure for the Harda Polres X unit in the form of a laptop or computer and printer as support in handling cases of land crimes.

b.    Procurement of special tools that must be owned by Harda Polres X to support investigators' infrastructure in uncovering land crimes.

 

E.      Case Handling Mechanism

From the explanation given related to the handling of land criminal cases, the Harda Polres X unit has been carried out by the applicable provisions and procedures (Saputra et al., 2022). However, there are still some things that are expected to be improved, especially in the planning process. It is related in terms of time management. Judging from the type of case, land crimes can be classified into cases with a high level of difficulty. Therefore, an extra work system is needed. Not to mention seen from the number of land cases that have entered quite a lot, and is hoped that the priority scale in handling these cases. In addition, a sense of responsibility is needed between investigators/assistant investigators together with relevant agencies related to the investigation of land crimes (Gunawan, 2006).

The National Police has made various efforts to overcome obstacles in the fight against crime in rural areas. To enforce the performance of investigators/assistant investigators to eradicate land crimes and to foster trust in the community towards the National Police, especially the Harda Polres X unit, the efforts made are as follows:

a.  Human Resources (HR)

1.      By increasing faith and piety of all investigators/assistant investigators of the Harda Polres X unit through spiritual activities or worship and spiritual showers.

2.      By involving all personnel of investigators/assistant investigators of the Harda Polres X unit to take part in research vocational education or vocational education regarding land crimes.

3.      By compiling training programs and capabilities periodically and in a planned manner by involving all investigators/assistant investigators of the Harda Polres X unit.

4.      By providing opportunities for all personnel investigators/assistant investigators of the Harda Polres X unit to develop their abilities or by attending public school education at universities.

5.      Each member or individual must improve and understand the Land Law.

6.      Must carry out Anev at each implementation of activities and investigations or investigations to find out the obstacles faced during the investigation of land cases. So that in the future there will no longer be the same obstacles that will interfere with the process of both examinations and investigations of land cases.

b.  Facilities and Infrastructures

1.      Carry out an inventory of the facilities and infrastructure owned by the Harda Polres X unit.

2.      Carry out analysis and evaluation to determine the effectiveness and efficiency of the use of existing facilities and markets as well as maintain or maintain existing facilities and markets so that they remain in good condition and fit for use.

3.      Propose requests for facilities and markets to complete the investigation of the Harda Polres X unit in the form of laptops, computers, and printers.

4.      Defined System and Method.


 

5.      Increase cooperation between Harda Polres X and other related parties.

6.      Increase cooperation between the Harda Polres X and the community by way of counseling about land crimes (Yuningsih, 2013).

7.      By the authority obtained, the National Police are required to be able to provide a sense of security and peace, as well as legal certainty to the community. The National Police as the spearhead in law enforcement is certainly very professional in enforcing a criminal case so that the public's sense of trust in the National Police is not lost.

 

CONCLUSION

From the explanation given regarding the handling of land criminal cases, the Harda Polres X unit has carried out the applicable provisions and procedures (Saputra et al., 2022). However, there are still some things that are expected to be improved, especially in the planning process. This is related in terms of time management. Judging from the type of case, land crimes can be classified into cases with a high degree of difficulty. Therefore, an extra work system is needed.
